Terms of Service & Privacy Policy
Effective date: 21 July 2026
This document has two parts: Part I — Terms of Sale and Part II — Privacy Policy (including a Cookie section). By completing a purchase you accept both parts.
1. General provisions
1.1. The online store available at horsenebulizer3d.com is operated by Dreamplex Sp. z o.o., registered office at ul. Juliusza Słowackiego 42/2, 60-822 Poznań, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) under number 0000512313, whose registration files are kept by the District Court Poznań – Nowe Miasto i Wilda in Poznań, 8th Commercial Division of the National Court Register; share capital: PLN 5,000; Tax ID (NIP): 7831713657, REGON: 302742593 (the "Seller").

1.3. These Terms set out the rules for the sale of digital content — files intended for 3D printing (the "Products") — and the conditions for the provision of electronic services.
1.4. A customer ("Customer") may be a natural person with full legal capacity, a legal person, or an organizational unit.
1.5. A "Consumer" is a Customer who is a natural person making a purchase for purposes not directly related to their business or professional activity. Provisions concerning the Consumer also apply to a natural person concluding a contract directly related to their business activity where the contract is not of a professional nature for that person (sole trader with consumer rights).
2. Payment and delivery operator (Gumroad)
2.1. The sale, payment, and delivery of the file are carried out via the Gumroad platform (Gumroad, Inc.), which acts as the payment operator and Merchant of Record for tax settlement purposes.
2.2. In this role, Gumroad is responsible for collecting and remitting the applicable tax (including VAT) on the transaction with the Customer.
2.3. By completing the purchase, the Customer additionally accepts Gumroad's own terms of service and privacy policy available on that platform.
2.4. The Seller remains the author, licensor, and party responsible for the content and quality of the Product.
3. Products and licence
3.1. Products are digital files (e.g. STL / OBJ / 3MF or other formats indicated in the description) intended for 3D printing.
3.2. With the purchase, the Customer acquires a non-exclusive, non-transferable licence to use the Product. Unless the Product description states otherwise, the licence covers: printing the model for the Customer's own private use, and modifying the file for the Customer's own printing.
3.3. Without a separate commercial licence, the Customer is prohibited from: reselling, sharing, or distributing the file (in whole or in part); making the file available to third parties; and using prints for commercial purposes (selling prints), unless the Product description provides a commercial licence.
3.4. All copyright in the Products belongs to the Seller and is not transferred to the Customer.
4. Conclusion of the contract and performance
4.1. An order is placed via the Product page with redirection to the Gumroad checkout.
4.2. The contract is concluded upon confirmation of payment.
4.3. The Product is delivered immediately after payment is registered — via a download link / access in the Gumroad account sent to the Customer's email address.
4.4. The Customer acquires the right to use the downloaded file indefinitely (under the licence in Section 3). After download, the file remains with the Customer for use without time limit.
4.5. The Seller does not, however, guarantee the indefinite availability of the file for re-download. The ability to download (including re-download) the Product from Gumroad exists for as long as the Gumroad platform and its infrastructure allow, which is beyond the Seller's full control. Gumroad ceasing to host the file or changing its rules does not constitute non-performance by the Seller.
4.6. Accordingly, the Seller recommends that the Customer download and save the file independently immediately after purchase and keep a backup. The Seller is not liable for the inability to re-download the file after it has been made available to the Customer.
4.7. Using the Product requires software supporting the given file format and a device capable of opening it.
5. Prices and payments
5.1. Prices are displayed by default in euro (EUR). During checkout the Customer may select a different payment currency from those offered by Gumroad; currency conversion and handling are provided by Gumroad. Prices include applicable taxes settled by Gumroad.
5.2. Available payment methods are determined by Gumroad (payment cards, PayPal, and others).
5.3. Proof of purchase is issued in accordance with Gumroad's rules; on request, the Seller may issue an invoice — contact: marcin.majkowski@dreamplex.pl.
6. Right of withdrawal (Consumer) and waiver for digital content
6.1. As a rule, a Consumer has the right to withdraw from a distance contract within 14 days without giving a reason.
6.2. Pursuant to Article 38(13) of the Polish Consumer Rights Act (implementing Article 16(m) of Directive 2011/83/EU), the right of withdrawal does not apply to contracts for the supply of digital content not supplied on a tangible medium if performance has begun with the Consumer's express and prior consent, the Consumer having been informed before performance began that they would lose the right of withdrawal once performance is complete and having acknowledged this, and the Seller having provided confirmation of the contract.
6.3. When ordering a digital Product, the Consumer selects the relevant statements (checkboxes) consenting to immediate delivery of the digital content and confirming awareness of the loss of the right of withdrawal. Without selecting these statements, immediate delivery does not occur.
6.4. Because the file is delivered immediately upon purchase, once the Consumer has given the consent in Section 6.3, the statutory right of withdrawal is validly excluded and the sale is treated as final (no refund on withdrawal grounds).
7. Complaints (conformity of digital content)
7.1. The Seller is liable to the Consumer for the conformity of the digital content with the contract under Chapter 5b of the Polish Consumer Rights Act.
7.2. A complaint may be submitted to marcin.majkowski@dreamplex.pl, stating the Customer's details, a description of the non-conformity, and the request.
7.3. The Seller examines the complaint within 14 days and informs the Customer of the outcome.
7.4. The Consumer may use out-of-court complaint resolution methods, including the ODR platform: https://ec.europa.eu/consumers/odr.
8. Technical requirements and prohibition of unlawful content
8.1. Using the store requires a device with internet access and a current browser, and an active email address.
8.2. The Customer is prohibited from supplying content of an unlawful nature.
9. Nature of the Product and disclaimer
9.1. The Product (3D model) is solely a digital file of general purpose (hobby / decorative / functional as described). The Product is not a medical device within the meaning of applicable law and is not intended for medical, diagnostic, therapeutic, or any other uses that require separate certification or approval.
9.2. The Customer prints and uses the print at their own risk.
9.3. The Customer acknowledges that the final result of the print depends on the equipment used (the 3D printer), the material, its quality, and the technical condition of the device, as well as the Customer's settings and skills — factors independent of the Seller and beyond the Seller's control.
9.4. The Seller is not liable for the quality, properties, durability, or fitness for a particular purpose of the physical print, nor for any damage arising in connection with printing or use of the print. The Seller's liability concerns solely the conformity of the delivered digital file with its description (per Section 7).
9.5. The above limitations do not exclude or limit the Consumer's rights under mandatory provisions of law, in particular those concerning the conformity of digital content with the contract.
10. Final provisions
10.1. Matters not regulated herein are governed by Polish law, including the Civil Code, the Consumer Rights Act, and the Act on Providing Services by Electronic Means.
10.2. The Seller may amend these Terms for important reasons; orders placed before an amendment are governed by the previous version.
10.3. These Terms are effective from 21 July 2026.

3. Data recipients
Your data may be shared with: Gumroad, Inc. — payment operator and Merchant of Record carrying out the transaction and file delivery; Meta Platforms, Inc. (Facebook) — in connection with the Meta Pixel tool for advertising and measurement (see Section 5); hosting, email, and analytics providers; and entities authorized under applicable law.
4. Transfers outside the EEA
We use providers based in the USA (including Gumroad and Meta). Transfers to the USA are based on the European Commission adequacy decision (EU-US Data Privacy Framework) or Standard Contractual Clauses (SCC). This may involve risks inherent to third countries.
5. Meta Pixel
5.1. We use the Meta Pixel tool provided by Meta Platforms Ireland Ltd. / Meta Platforms, Inc.
5.2. The Pixel collects information about your activity on the site (e.g. visits, purchase events) to serve ads, run remarketing, and measure effectiveness.
5.3. For the events collected by the Pixel, the Controller and Meta act as joint controllers under Meta's Controller Addendum.
5.4. The Pixel is triggered only after you consent to marketing cookies in the consent banner. You may withdraw consent at any time via the cookie settings.

6. Cookies
6.1. Cookies are small text files stored on your device when using horsenebulizer3d.com. We also use similar technologies (pixels, local storage).
6.2. Types of cookies used: Essential — required for the site to function; no consent needed. Analytics/statistics — help us understand site usage; require consent. Marketing — used for advertising and remarketing, including Meta Pixel (Facebook); require consent.
6.3. Analytics and marketing cookies are triggered only after you give consent in the consent banner shown on your first visit. Until then, we do not run Meta Pixel or other marketing/analytics tools. The banner offers equally weighted "Accept all" and "Reject all," plus granular per-category choice. You may change or withdraw consent at any time via the "Cookie settings" link on the site.
6.4. Example cookies: _fbp (Meta, marketing, up to 90 days), fr (Meta, marketing, up to 90 days), analytics cookies such as _ga (analytics), and a session cookie (Seller, essential, session). Adjust this list to the tools actually deployed; a CMP banner usually generates the current list automatically.
6.5. You can manage cookies in your browser settings (blocking, deleting). Restricting essential cookies may affect how the site works.
7. Your rights
You have the right to: access your data, rectification, erasure, restriction of processing, data portability, objection, and withdrawal of consent at any time (without affecting the lawfulness of processing before withdrawal). You also have the right to lodge a complaint with the President of the Personal Data Protection Office (UODO) in Poland. To exercise your rights, contact: marcin.majkowski@dreamplex.pl.
8. Voluntary nature
Providing data is voluntary but necessary to conclude and perform the contract. Marketing and cookie consents are entirely voluntary.
